Insurance is widespread and important in our society. People who own and register vehicles have automobile liability insurance. A great many people who own homes have homeowners insurance, and depending on where people live they may also have flood insurance. Many or most people have medical, or health, insurance, and many people also have disability insurance. A great number of people who provide professional services to others, for example, doctors, lawyers, accountants, architects, engineers, title companies, real estate brokers, real estate managers, etc., have "errors and omissions," i.e., "malpractice," insurance. It is commonplace for businesses to have liability insurance for injuries caused to others as a result of their business operations and sometimes also for damage to the businesses' property. Workers' compensation insurance and employers' liability insurance is also common in the work place.
"Insurance policies" are contracts. People pay fees, or "premiums," to purchase insurance policies through which insurance companies will "cover," i.e., pay, particular types of claims. The definition of the "coverage" provided is in the insurance policy, as are the dollar limits up to which the insurance company will provide coverage. Insurance policies, however, contain numerous terms and conditions that must be met before claims are potentially covered. Insurance policies also contain "exclusions" that remove certain types of claims from the coverage otherwise provided.
As many people who have made insurance claims know, disputes over the scope of the "insurance coverage" provided under insurance policies are frequent. People who make insurance claims often believe that the insurance companies interpret the coverage provided too narrowly and interpret the terms and conditions that must be met and interpret the exclusions too broadly in order to avoid paying claims.
